Terms of Service

The rules for using TryTool — please read them carefully.

These Terms govern your access to and use of TryTool. If you read only one section, read Estimates and Information Are Not Advice.

1At a Glance

The short version. The sections below govern — this summary does not.

  • TryTool is a business tool. Use it lawfully and keep your login to yourself.
  • You keep ownership of what you enter. Records created for a company belong to that company.
  • Rates, estimates and weather information are for information only, and are never a safety system.
  • The Service is provided as is, and our liability to you is limited.

2Accepting These Terms

By using TryTool (the "Service") you agree to these Terms. If you use it for a company, you confirm you may accept them on that company's behalf. If you do not agree, do not use the Service.

3Your Account

  • You must be at least 18 and able to enter a binding contract.
  • Keep your password to yourself and do not share a login. You are responsible for what happens under your account.
  • Tell us promptly if you suspect someone else has access. Changing your password ends existing sessions.
  • What you can reach depends on your role. Do not try to reach data or functions your account is not entitled to.

4Acceptable Use

Do not:

  • Break the law, infringe anyone's rights, or deceive.
  • Try to get around sign-in, access controls or usage limits.
  • Scrape or bulk-export data you did not provide, or use the Service to build a competing product.
  • Upload malware, or files you have no right to upload.
  • Disrupt the Service or load it in a way that affects other users.

5Your Content

You keep ownership of what you put into the Service. You give us only the permission needed to run it: to store, process, display and back up your content, and to produce the features you use.

Records entered for a company belong to that company rather than to the person who typed them, and its administrators may correct or remove them.

When you enter information about other people — drivers or contacts, for example — you confirm you are entitled to, and you are responsible for it being accurate and lawful.

6Estimates and Information Are Not Advice

Rates, estimates, analytics, distances, weather and hazard information are provided for information only. They come from historical records and third-party data, may be delayed, incomplete or wrong, and are not a quote, a market price, or a recommendation.

Weather and hazard information is not a safety system. Do not rely on it for driving, routing or dispatch safety decisions — use official weather warnings, road authorities and the driver's own judgement. Always check values read from an uploaded document against the original.

Nothing in the Service is legal, financial, tax, insurance or compliance advice.

7Availability and Changes

We aim to keep the Service running but cannot guarantee uptime. It may be unavailable for maintenance, or for reasons outside our control such as problems at the providers it depends on. We may add, change or remove features at any time. Features marked as beta may be incomplete and may be withdrawn without notice.

8Third Parties and Advertising

The Service relies on third parties and may link to other sites. We do not control them and are not responsible for their content or availability; their own terms apply. The Service also shows advertising, including through Google AdSense — the Privacy Policy explains what that involves. Advertisements are not endorsements.

9Intellectual Property

The Service — its software, design, text and branding — belongs to TryTool and its licensors. These Terms give you a limited, non-exclusive, non-transferable, revocable right to use it for your business. You may not copy, modify or create derivative works from it, except where that restriction cannot be enforced by law. If you send us suggestions, we may use them without obligation to you.

10Ending Access

We may suspend or end access at any time if we believe these Terms have been breached, or to protect the Service and its users. Your company's administrators may deactivate accounts. You may stop using the Service whenever you like. Terms that should outlast the agreement — ownership, disclaimers, limitation of liability, indemnity and governing law — continue to apply.

11Disclaimer of Warranties

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the Service will be uninterrupted, secure or error-free, or that any figure or estimate in it is accurate or current.

12Limitation of Liability

To the maximum extent the law allows, TryTool is not liable for indirect, incidental, special, consequential or punitive damages, nor for lost profits, lost or delayed loads, lost or corrupted data, or business interruption.

Where liability cannot be excluded, our total liability relating to the Service is limited to the greater of what you paid us for it in the twelve months before the claim, or US$100. Some places do not allow these exclusions, so parts of this section may not apply to you.

13Indemnity

You agree to indemnify and hold harmless TryTool and its operators against claims, damages, losses and reasonable legal costs arising from your use of the Service, your content, your breach of these Terms, or your violation of any law or third-party right.

14Governing Law

TryTool is operated from Pennsylvania, United States. These Terms are governed by the laws of the Commonwealth of Pennsylvania and the United States, without regard to conflict-of-laws rules, and the state and federal courts located in Pennsylvania have exclusive jurisdiction over any dispute. If a provision cannot be enforced, the rest stays in force; not enforcing a provision is not a waiver of it.

15Changes to These Terms

We revise these Terms as the Service changes. The date at the top shows the last revision, and we announce material changes in the app. Using the Service after a change means you accept the revised Terms.
